The purpose of the privacy policy is to inform how the personal data of data subjects is collected and processed, to explain how long it is stored, to whom it is provided, what rights data subjects have, and where to apply for their implementation or other issues related to the processing of personal data.

Personal data is processed in accordance with the European Union General Data Protection Regulation (EU) 2016/679 (hereinafter referred to as the Regulation), the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other legal acts regulating the protection of personal data. 
MB „JazbArt Beauty“ adheres to the following fundamental data processing principles:

  • personal data shall be processed only lawfully, fairly, and transparently (principle of lawfulness, fairness, and transparency);
  • personal data shall be collected only for clearly defined and legitimate purposes (principle of purpose limitation);
  • personal data is processed in an adequate, appropriate, and limited manner in relation to the purposes for which it is processed (principle of data minimization);
  • personal data is accurate and kept up to date (principle of accuracy);
  • personal data is stored securely and for no longer than is necessary for the purposes of data processing or as required by law (principle of storage limitation);
  • personal data is processed using appropriate technical or organizational measures to ensure adequate security of personal data (principle of integrity and confidentiality).
1. TERMS
 

1.1. Data controller – MB „JazbArt Beauty“ (hereinafter referred to as the Company), legal entity code 305570548, registered office address: Neringos g. 57E, Rusnė, LT-99349 Šilutės r.
1.2. Data subject – any natural person whose data is processed by the Company. The data controller collects only those data subjects' data that are necessary for the Company's activities and/or when visiting, using, browsing the Company's websites, etc. (hereinafter referred to as the Website). The Company ensures that the personal data collected and processed will be secure and will only be used for a specific purpose.
1.3. Personal data – any information directly or indirectly related to a data subject whose identity is known or can be directly or indirectly determined using the relevant data. Personal data processing is any operation performed on personal data (including collection, recording, storage, editing, modification, access, retrieval, transfer, archiving, etc.). 
1.4. Consent – any freely given, specific, informed, and unambiguous indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

2. SOURCES OF PERSONAL DATA
2.1. Personal data is provided by the data subject themselves. The data subject contacts the Company, uses the services provided by the Company, purchases goods and/or services, participates in loyalty programs or competitions, leaves comments, asks questions, subscribes to newsletters, contacts the Company to request information, etc. 

2.2. Personal data is obtained when the data subject visits the Company's website. The data subject fills in the forms on the website or, for some reason, leaves their contact details, etc.
2.3. Personal data obtained from other sources. Data obtained from other institutions or companies, publicly available registers, etc.

3. PROCESSING OF PERSONAL DATA
3.1. By submitting personal data to the Company, the data subject agrees that the Company may use the collected data in order to fulfill its obligations to the data subject and provide the services expected by the data subject. 3.2. The Company processes personal data for the following purposes:   3.2.1. Concluding and performing contracts with the data subject for the services and goods provided and received by the Company; storing contacts, ensuring the possibility to contact them; tax accounting and payment control. The following data is processed for this purpose: 
  • First name(s), last name(s);
  • Contact details (phone number, email address);
  • Place of work and position (if the information is provided as a representative of a legal entity);
  • Residential address (for VAT invoices);
  • Bank account details.
3.2.2. Administration of inquiries, comments, and complaints. The following data is processed for this purpose:
  • First name(s); 
  • Contact details (phone number, email address);
  • Text of the question, comment, or complaint.

3.2.3. Direct marketing, loyalty card administration. The following data is processed for this purpose:

  • First name(s), last name(s);
  • Date of birth (age);
  • Gender;
  • City;
  • Contact details (phone number, email address);

3.2.4. E-commerce. The following data is processed for this purpose:
For customer/buyer identification:

  • First name(s), last name(s);

To contact the customer/buyer:

  • Contact details (phone number, email address).

For order delivery:

  • Delivery address.

To complete the purchase: 

  • Payment details for goods/services (bank account number, payment method, etc.);
  • Purchase history (purchased goods and/or services, price, quantity);
  • Order date;
  • Purchase receipt No.

3.2.5. Other purposes for which the Company has the right to process the personal data of the data subject when the data subject has given his or her consent, when the data needs to be processed due to the legitimate interests of the Company, or when the Company is required to process the data by applicable law.

 
4. PROVISION OF PERSONAL DATA

4.1. The company undertakes to comply with the confidentiality obligation in relation to data subjects. Personal data may be disclosed to third parties only if necessary for the conclusion and performance of a contract for the benefit of the data subject or for other legitimate reasons.
4.2. The Company may provide personal data to its data processors who provide services to the Company and process personal data on behalf of the Company. Data processors have the right to process personal data only in accordance with the Company's instructions and only to the extent necessary to properly perform the obligations set forth in the contract. The Company only uses data processors who sufficiently ensure that appropriate technical and organizational measures will be implemented in such a way that data processing complies with the requirements of the Regulation and the protection of the rights of the data subject is ensured. 
4.3. The company may also provide personal data in response to requests from courts or public authorities to the extent necessary to comply with applicable laws and regulations and the instructions of public authorities.
4.4. The company guarantees that personal data will not be sold or rented to third parties. 

5. PERSONAL DATA RETENTION PERIOD

5.1. Personal data collected by the Company is stored in printed documents and/or the Company's information systems. Personal data is processed for no longer than is necessary to achieve the purposes of data processing or for no longer than is required by data subjects and/or provided for by law. 
5.2. Although the data subject may terminate the contract and refuse the Company's services, the Company shall continue to store the data subject's data in case of possible future claims or legal claims until the data storage periods expire.

6. RIGHTS OF THE DATA SUBJECT
6.1. Right to obtain information about data processing.

6.2. Right to access processed data. 
6.3. Right to request correction of data.
6.4. Right to request deletion of data („Right to be forgotten“). This right does not apply if the personal data requested to be deleted is processed on another legal basis, such as processing necessary for the performance of a contract or the fulfillment of obligations under applicable law.
6.5. Right to restrict data processing.
6.6. Right to object to data processing.
6.7. Right to data portability. The right to data portability shall not adversely affect other rights and freedoms. 
6.8. The right to request that a decision based solely on automated processing, including profiling, not be applied.
6.9. The right to lodge a complaint regarding the processing of personal data with the State Data Protection Inspectorate.
6.10. The company must create conditions for the data subject to exercise the above-mentioned rights of the data subject, except in cases established by law where it is necessary to ensure national security or defense, public order, the prevention, investigation, detection, or prosecution of criminal offenses, important economic or financial interests of the state, the prevention, investigation, and detection of violations of official or professional ethics, and the protection of the rights and freedoms of the data subject or other persons.

7. PROCEDURE FOR EXERCISING THE RIGHTS OF THE DATA SUBJECT

7.1. The data subject may contact the Company regarding the exercise of their rights:
7.1.1. by submitting a written request in person or by electronic means – by email: info@alixavien.lt; The request must be legible, signed by the data subject, using a free form and format.
7.1.2. verbally – by telephone +370666 43 817; 
7.2. In order to protect data from unlawful disclosure, the Company must verify the identity of the data subject upon receiving a request from the data subject to provide data or exercise other rights.
7.3. The company's response to the data subject shall be provided no later than one month from the date of receipt of the data subject's request, taking into account the specific circumstances of the processing of personal data. This period may be extended by a further two months, where necessary, taking into account the complexity and number of requests.

8. RESPONSIBILITY OF THE DATA SUBJECT 
8.1. The data subject shall have:

8.1.1. inform the Company of any changes to the information and data provided. It is important for the Company to have accurate and valid information about the data subject;
8.1.2. provide the necessary information so that, upon the data subject's request, the Company can identify the data subject and verify that it is communicating or cooperating with the specific data subject (provide a document confirming the person's identity or in accordance with the procedure established by law or by electronic means that would allow the data subject to be properly identified). This is necessary for the protection of the data subject and other persons, so that the disclosed information about the data subject is provided only to the data subject, without violating the rights of other persons.

9. FINAL PROVISIONS 

9.1. By submitting personal data to the Company, the data subject agrees to this Privacy Policy, understands its provisions, and agrees to comply with them. 
9.2. In order to develop and improve the Company's activities, the Company has the right to unilaterally amend this Privacy Policy at any time. The Company has the right to unilaterally amend the Privacy Policy, in whole or in part, by posting a notice on its website.
9.3. Additions or changes to the Privacy Policy shall take effect on the date of their publication, i.e., on the date they are posted on the website.

10.1. In order to improve the functioning of the Website so that data subjects (visitors) can easily find what they are looking for, the Company uses the following cookies:
