Placing an order for goods
1. ORDERING GOODS
1.1. Both registered and unregistered Customers can order goods on the website alixavien.lt.
1.2. Customer orders are registered in the electronic database at alixavien.lt.
2. RIGHTS AND OBLIGATIONS OF THE CUSTOMER
2.1. The customer has the right to order goods of their choice on the alixavien.lt website in accordance with the procedure set out in these rules.
2.2. The customer has the right to refuse and return goods ordered on the alixavien.lt website.
2.3. The Customer must keep their login details for the alixavien.lt website safe; otherwise, the Customer will be responsible for data protection.
3. RIGHTS AND OBLIGATIONS OF THE COMPANY
3.1. The Company may carry out various marketing campaigns and, with the prior consent of the Customers, inform them about these campaigns by sending information to the contact details provided by the Customer.
3.2. The Company also has the right to unilaterally change marketing campaigns and conditions at any time without prior notice and to terminate campaigns that have already begun.
3.3. The company has the right to change and improve the functions of the alixavien.lt website and to suspend the website's activities if necessary.
3.4. The company undertakes to provide the conditions for ordering goods on the alixavien.lt website and to deliver them to the address chosen by the customer.
3.5. The Company undertakes to inform the Customer about the confirmation of the order and the delivery of the ordered goods.
3.6. The Company undertakes to store and manage the Customer's data.
4. Joint Responsibility
4.1. The customer is responsible for the accuracy of the data provided in the registration and/or purchase form. The customer assumes responsibility for the consequences arising from the inaccuracy or incorrectness of the data provided in the registration and/or purchase form.
4.2. The parties shall be liable for any breach of the purchase and sale agreement concluded via the online store in accordance with the procedure established by the laws of the Republic of Lithuania.
4.3. Taking into account the provisions of Article 8(3) of the Law on Electronic Signatures of the Republic of Lithuania, the Customer agrees with the Company that confirmation of the Customer's actions in the online store by logging in to the online store with their data (identification code) has the legal force of an electronic signature as established in Article 8(1) of the Law on Electronic Signatures (i.e., it has the same legal force as a signature on written documents and is admissible as evidence in court). The customer must keep their login details for the online store safe and not disclose them, ensure that the details are known only to them and used only by them, and not transfer them or otherwise allow other persons to access or use them. If there is a suspicion that the login details may have been disclosed to another person, the Customer must immediately notify the Company thereof, as well as immediately inform the Company of any breach or disclosure of the login details for the online store. All actions performed using the Customer's identification code are considered to have been performed by the Customer, and the Customer assumes full responsibility for the consequences of such actions.
4.4. The Company shall not be liable for information provided on other companies' websites, even if the Customer accesses these websites via links on the alixavien.lt website.
4.5. The company is not responsible for the fact that the goods displayed on the alixavien.lt website do not correspond to the actual size, shape, and color of the goods due to the characteristics of the display used by the Buyer.
5. Processing of personal data and sending of information
5.1. By clicking the „Order“ button, the Customer confirms that they and their representatives (the Customer has the consent of their representatives) agree to provide the Company with their personal data and do not object to the Company processing the personal data provided by the Customer and/or their representatives for the purposes of identifying the Customer and/or their representatives, conclusion and performance of contracts (online sales), and direct marketing purposes. The Company states that it will not process the personal identification numbers of the Customer (if the Customer is a natural person) and his/her representatives for direct marketing purposes.
5.2. Both registered and unregistered members will receive the newsletter by clicking on the “Subscribe to newsletter” button, after which the customer will automatically start receiving newsletters, which they can unsubscribe from by clicking on the link at the bottom of the newsletter. The Seller sends all informational messages to the email address provided in the Buyer's order form.
5.3. By clicking on the „Order“ button, the Customer confirms that he/she (if the Customer is a natural person) and his/her representatives are informed about their right to access their personal data processed by the Company and how it is processed, to request correction, destroy their personal data or suspend the processing of their personal data when the data is processed in violation of the provisions of the law, and to refuse to allow their personal data to be processed.
5.4. By clicking the „Order“ button, the Customer confirms that they and their representatives are aware of their right to refuse to provide their personal data, but understand that personal data is necessary and essential for the unambiguous identification of the Customer and/or their representatives for the purposes of concluding contracts, and, if they do not provide their personal data and/or do not consent to its processing for the above purposes, they will not be able to conclude and/or perform the contract.
6. Final provisions
6.1. The Company has the right to amend the Rules by posting a notice on its website.
6.2. Additions or amendments to the Rules shall come into force on the date of their publication, i.e. on the date they are posted on the website.
Return of goods
1. Terms and conditions for returning goods:
1.1 The Buyer may exercise the right to return a quality and unused product within 14 (fourteen) days from the date of receipt of the goods by notifying the Seller thereof.
1.2 Defective goods shall be returned in accordance with the cases and procedures provided for in the legislation.
1.3 The following conditions apply to the return of quality goods:
- The buyer's notification to the seller about the return of goods is submitted in accordance with the terms set for the return of goods – 14 days from the date of receipt of the goods.
- The product must not be damaged by the Buyer.
- The returned product must be in its original, undamaged packaging, unused (untested), and in good condition (labels intact, protective film not removed, etc.) (this clause does not apply in the case of returning a defective product).
- The returned product must be in the same condition as it was received.
- All gifts received together with the purchased goods must be returned together with the returned goods.
- When returning a product, you must present the purchase receipt/invoice and a completed product return request form.
1.4 If the goods are not complete, are damaged, untidy, or not properly packaged, the Seller has the right not to accept the goods, not to exchange them, and not to refund the money paid by the buyer for the goods.
2. Returning goods:
2.1 Where to return the goods: If the conditions listed in point 1 are met, please follow these steps to return the goods:
- Goods must be returned to the address specified by the Seller. Courier fees are paid by the buyer.
- When returning goods, you must present the purchase receipt or invoice and fill out a return form.
2.2 How will the money be refunded?
- If the goods were delivered by courier and returned by other means (by post, etc.), after receiving the goods and assessing their condition, the amount paid for the goods will be refunded within 30 days of the date of return to the bank account specified by the payer.
